UK Top Court Rules “Woman” Legally Defined by Biological Sex in Landmark Decision

On April 16, 2025, in London, England, In a significant and potentially far-reaching judgment, the UK Supreme Court has today ruled that the legal definition of “woman” under the Equality Act 2010 refers to biological sex. The unanimous decision from the country’s highest court clarifies the interpretation of a key term within anti-discrimination legislation, settling a contentious debate.
The ruling emerged from a legal challenge brought by the feminist group For Women Scotland (FWS) against guidance issued by the Scottish government. The guidance had suggested that “woman” could include transgender women with a Gender Recognition Certificate (GRC) for the purpose of achieving gender balance on public sector boards. FWS argued that the Equality Act’s definition of “sex” should be understood as biological sex.
The Supreme Court sided with FWS, stating unequivocally that “sex” in the Equality Act refers to biological sex – whether a person was born male or female. The court reasoned that interpreting “sex” to encompass those with a GRC would create complexities and potential inconsistencies within the Act’s application.


While the ruling clarifies the definition of “woman” based on biological sex, the court was careful to emphasize that transgender individuals retain full protection from discrimination under the Equality Act through the protected characteristic of “gender reassignment,” as well as broader provisions against direct and indirect discrimination and harassment.


The decision has elicited strong reactions from various groups. Supporters, including FWS, celebrated the ruling as a crucial affirmation of women’s rights and the importance of biological sex in certain legal contexts, particularly concerning single-sex spaces and services. Conversely, transgender rights advocates voiced disappointment and apprehension, expressing concerns that the judgment could lead to increased exclusion and discrimination against transgender women.


The UK government has indicated its support for the clarity provided by the Supreme Court’s judgment, reiterating its commitment to protecting single-sex spaces based on biological sex. The long-term implications of this landmark ruling are likely to be debated and analyzed across various sectors as organizations and policymakers navigate its impact on equality and inclusion efforts.
